The Supreme Court of Canada has issued a decision upholding the decision of the High Court that found that the Food and Drug Administration (FDA) has prohibited certain drugs from being sold without a prescription in the United Arab Emirates. The decision of the High Court was announced by a special commissioner of the Federal Court of Justice (FJ) as follows:
“The decision of the High Court (C) is contrary to the spirit of the Code of the Supreme Court of Canada, the Code of the Supreme Court of Canada and the spirit of the Code of the Supreme Court of Canada to the extent of its rejection of the decision of the High Court that the Food and Drug Administration (FDA) has prohibited certain drugs from being sold without a prescription in the United Arab Emirates,”
In this instance, the Court was informed that the decision was of the “clear and presentment” principle, not of the fundamental spirit. Further, the High Court did not say the legal process had been established in order to protect the public from unauthorised sale of such drugs without a prescription. It stated that the “right to health has long been a fundamental principle of human nature and must be protected when the laws of the jurisdiction of the jurisdiction of the High Court are violated.” The High Court’s decision was consistent with the principles of the Supreme Court of Canada that were adopted by the Supreme Court of Canada in 1997. The High Court ruled that the Food and Drug Administration (FDA) had prohibited the sale of Viagra, the drug marketed as the “Viagra for Women”, for the purposes of a generic drug. Viagra is marketed under the brand name “Cialis” and is approved by the FDA. The FDA has previously ruled that Viagra is only available through prescription and that the approval of generic versions of Cialis is not a valid public health act.
The High Court was therefore in error that it was a clear violation of the fundamental spirit of the Code of the Supreme Court of Canada.
This decision is also in line with the principle that the Court of Justice is a lower court with exclusive jurisdiction to make decisions on issues that fall within the boundaries of the Code of the Supreme Court of Canada.
